The website creation service (the “Service”) provided at firstwebsite.com.au is subject to the following conditions of use. By using the Service in any way, you agree to and accept these terms and conditions (“Terms”).
We reserve the right to change the Terms at any time and without notice. You will be notified of any change in these terms and conditions. The current Terms will be shown here.

Service description
Our web-based Service allows users who register for an account (each an “Account Holder”) to create and update an online web site. Once registered, each Account Holder is given access to the Service and may post website content on a subdomain of firstwebsite.com.au.
The Service may include communications from us, such as service announcements, administrative messages and an occasional Newsletter. These communications are considered a condition of use. You may not access the Service by any means other than through the Service interface we provide you.

To become a user of the Service, you must provide us with a valid email address and other information as we may require to create your account. You will choose a password during the registration process. You are responsible for maintaining the confidentiality of the password and account, and for all activities that occur under your account. You agree to maintain and update current and complete Registration Data. If you provide any information that is untrue, inaccurate, not current or incomplete, or if we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, we may suspend or terminate your account.

You are responsible for all text, images or other materials (“Content”) you make available from the website.
We do not control the Content you post via the Service.
You acknowledge that we do not pre-screen Content, but that we have the right to suspend or terminate any account with Content that violates our unacceptable use or is otherwise objectionable at our sole discretion.

Unacceptable use
Unacceptable uses include, but is not limited to:

  • illegal purposes
  • any infringement of intellectual property rights e.g. copyright, trademark
  • content which is libelous, threatening, discriminatory, obscene or pornographic

Full backups are made locally and to an external source. No guarantees are made of any kind, either expressed or implied, as to the integrity of these backups.
These backups are made for server restoration purposes only. We will assist where we can, but restoring an individual website may not always be possible.

A trial period is available at no cost. At the end of the trial period, unless the fee is received, the account will be deleted.
The fee for the Service is for a period of 12 months. There is currently no other period offered. This fee is required in advance.
We do NOT automatically charge you upon expiry of your service. One month prior to expiry, we send you an invoice for the next year’s service. Upon receipt of payment, your service will commence on the later of the expiry date of your current service or the date we receive funds for 12 months of the Service.
We may change our fees at any time. When applicable, we’ll give you advance notice of these fee changes. New fees will not apply retroactively.

Refund policy
There is a free trial period available for you to determine whether the Service suits your needs. As such, there are no refunds issued, except at our sole discretion.

You can cancel your account at any time.
We may determine, at our sole discretion, your content or use of the Service is inappropriate and suspend or terminate your account at any time.

Indemnity / Liability
In no event shall we be liable for any loss.
You agree that you shall defend, indemnify, save and hold us harmless from any and all demands.

You use the service at your own risk. We cannot guarantee the Service will be uninterrupted or error-free.
We make no warranty of any kind regarding the Service.

Privacy policy
We will never sell or pass your personal information on to any 3rd party.
We will protect personal information by reasonable security safeguards against loss or theft, as well as unauthorized access, disclosure or modification.
